 These terms relate to the hire, loan or sale of any equipment or service and will be at the sole discretion and on the following terms or as varied from time to time without limiting our rights to refuse hire, loan, sale or service provision to any person or entity with or without explanation or liability. Terms and conditions of hire of cameras, accessories, attachments, fittings, filters, additional lens units, tripods, lighting, cases, manuals and camera instruction CD, media or any other equipment used for film making,video or digital imaging device whatsoever. 1. The ownership of any goods or services are owned by Avid Tech The Super 8 Guys, any associate, subcontractor or assignee remains under the ownership and total control of Avid Tech - ABN 828 343 008 31 8 Sussex Court Wonrhaggi Victoria 3995 Australia. Hire or rental is subject to availability and no warranty or promise can be made due to factors arising beyond the control of Avid Tech. 2a. Only real natural persons may hire equipment for personal use or by persons nominated by the hirer / renter. Equipment may not be hired by a business entity other than by an authorised person or a person delegated by permission or the principal director who will assume all liability and warrant the payment of hire fees and damages on behalf of the entity ( Directors Guarantee) and the person/s authorised to use hired equipment. 3. No warranty or guarantee of fitness or suitability for intended use is implied or given equipment is supplied in good faith and checked to be in a good and working order when leaving our premises. All equipment is second hand and there is no responsibility accepted for consequential loss or damages howsoever caused, wether by mistake, omission,accident or negligence. Nor will Avid Tech be liable for delays in transit or damage in transit of any item posted or delivered by courier. 4. Pre payment by credit card or B-Pay is required at least 48 hours prior to hire start / commencement. 5. A security deposit may be required at our sole discretion. 6. Late return fees are charged for each day equipment remains un returned. 7. Avid Tech reserves the right to seize or repossess any or all equipment hired to you at it's sole discretion. We are not required to provide you with a reason for re possession which may be undertaken to protect our interests and property rights. 8. Duty of care Care and custody or equipment supplied to you may only be used within the state or territory of residence unless prior approval is given in writing. Equipment must be considered fragile and valuable and must not be left unattended or left exposed to theft nor left visible in a parked motor vehicle. You must not use equipment in a hostile enforcement or extreme conditions, nor attempt to use the equipment outside a temperature range of -3 degrees to + 42 degrees. The hirer will protect the equipment from moisture or liquids. 9. You must not attempt to modify nor interfere with any equipment, parts or accessory in anyway whatsoever. 10. You must operate the equipment in a reasonable manner in accordance with instructions provided in writing or electronically. 11. You may only use the correct designated medea specified by the equipment manufacturer, such media must be recently acquired and not out of date.
